Terms of Service

Overview

Welcome to Ambitious Dreamz Collection. The store is operated by Ambitious Dreamz Studio LLC, trading as Ambitious Dreamz Collection. The terms we, us, and our refer to that business. Our store, website, related content, features, products, and services are collectively the Services. Shopify provides the ecommerce platform that enables us to offer the Services.

These Terms and the policies referenced here describe your rights and responsibilities. By using the Services or purchasing from us, you agree to the applicable Terms. Read our Privacy Policy (https://ambitiousdreamzcollection.myshopify.com/policies/privacy-policy), Shipping Policy (https://ambitiousdreamzcollection.myshopify.com/policies/shipping-policy), and Refund Policy (https://ambitiousdreamzcollection.myshopify.com/policies/refund-policy) before ordering. Acknowledging the Privacy Policy does not replace consent where legally required. Nothing in these Terms excludes rights or remedies that cannot lawfully be waived.

1. Access and account

You must have legal capacity to enter a purchase contract, or act with the permission and supervision required by applicable law. Provide accurate, current, and complete contact, billing, shipping, and account information, and only information you are entitled to provide. Keep account credentials secure and notify us of suspected unauthorized use. You may not sell, transfer, assign, or license your account to another person without permission.

2. Our products

We aim to describe and depict products accurately. Screens and device settings can affect displayed colors and appearance. Minor normal variations do not excuse a faulty or materially misdescribed product. Review product descriptions, size guides, materials, and care instructions. Many products are made to order through Apliiq or Printful. We may change future listings, availability, or quantities, but changes do not remove obligations for an accepted order or your statutory rights.

3. Orders

Submitting an order is an offer to purchase. Acceptance occurs when we confirm acceptance after processing payment. We may decline or cancel an order for a legitimate reason, such as unavailable stock, an unsupported delivery address, a material listing error, suspected fraud, or a legal restriction. We will notify you using the contact details provided and return any amount due for an order we do not fulfill.

Check your order carefully. Contact us promptly to request changes or cancellation; discretionary changes may not be possible once production begins. Statutory withdrawal and cancellation rights remain unaffected. Returns and other remedies are governed by our Refund Policy (https://ambitiousdreamzcollection.myshopify.com/policies/refund-policy) and applicable law. Purchases are for personal or household use unless we separately agree to a commercial arrangement.

4. Prices and billing

The price and currency shown at checkout and in your order confirmation govern your purchase. Prices and promotions may change for future orders. Taxes, shipping charges, and any duties collected at checkout are shown before payment. Other import or carrier clearance charges may apply as explained in our Shipping Policy. Promotions have their stated eligibility conditions; a product-specific promotion may differ from another product's offer.

Provide accurate payment information and use only a payment method you are authorized to use. You agree to pay the accepted order's disclosed charges. Apliiq and Printful shipping profiles can have different rates or free-shipping eligibility. Our $50 U.S. free-standard-shipping offer applies only to eligible U.S. orders and is not a blanket international offer. The final shipping amount is displayed before payment.

5. Shipping and delivery

Our Shipping Policy (https://ambitiousdreamzcollection.myshopify.com/policies/shipping-policy) explains supported destinations, restrictions, production, delivery estimates, tracking, and import charges. We serve the United States and selected international destinations, including Canada and Australia. We do not currently ship to the United Kingdom or other destinations excluded by our store.

Production and transit times are separate. Products may ship in multiple packages from Apliiq, Printful, or their fulfillment facilities. Estimates are not guarantees unless we expressly agree otherwise. Carrier disruptions, customs, and other events may cause delays. We remain responsible for any delivery obligations and remedies required by law. These Terms do not automatically transfer the risk of a lost shipment to a consumer merely because it has been handed to a carrier. Contact us about a delayed, missing, or damaged order.

6. Intellectual property

Store names, logos, original designs, text, images, graphics, audio, video, and the selection and arrangement of content belong to Ambitious Dreamz Studio LLC or the relevant rights holders. You may use the Services for their intended personal shopping purposes and as permitted by law. Reproduction, redistribution, commercial exploitation, or unauthorized use of protected content requires the relevant rights holder's permission. These Terms do not transfer ownership of our, Shopify's, or another party's intellectual property. Rights not expressly granted are reserved. Shopify's names and marks belong to Shopify; other third-party marks belong to their respective owners.

7. Optional tools

Optional third-party tools may be available through the Services. Unless expressly stated otherwise, we do not control those tools and provide access on an as-is and as-available basis to the extent permitted by law. Review the provider's terms before use. New store features are subject to these Terms where applicable. This section does not exclude our non-waivable duties or rights you have against a provider.

8. Third-party links

The Services may link to third-party websites, materials, or integrations. Their operators are responsible for their own services and policies. Review them before interacting or purchasing. A link alone is not an endorsement. Complaints about purchases directly from another business should be directed to that business. We remain your contact for purchases from Ambitious Dreamz Collection, including items produced or shipped by our fulfillment providers.

9. Relationship with Shopify

Ambitious Dreamz Collection is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Ambitious Dreamz Collection. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Ambitious Dreamz Collection, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Ambitious Dreamz Collection.

The preceding paragraph applies only to the extent permitted by applicable law and does not remove rights that cannot legally be excluded. Shop and Shop Pay may also be subject to Shopify's own applicable terms.

10. Privacy

Our processing of personal information is described in our Privacy Policy (https://ambitiousdreamzcollection.myshopify.com/policies/privacy-policy). Shopify's own processing is described in the Shopify Consumer Privacy Policy (https://www.shopify.com/legal/privacy/app-users). Information may be shared with Shopify, Apliiq, Printful, carriers, and other relevant providers to support orders and the Services, including processing outside your country as explained in those notices.

11. Feedback

When you voluntarily submit reviews, suggestions, ideas, or other content for use in connection with the Services, you grant us a worldwide, royalty-free, sublicensable license to use, reproduce, adapt, publish, distribute, and display that content to operate, improve, and promote the Services, subject to applicable law and our Privacy Policy. You retain ownership of your content and must have the rights necessary to submit it. Disclose any incentive received for a review.

We are not required to pay for, respond to, or keep unsolicited ideas confidential unless separately agreed. We may moderate unlawful, deceptive, abusive, infringing, or malicious content. Do not impersonate others, mislead about authorship, violate another person's rights, or upload malware. Private order-support information and personal information remain governed by our Privacy Policy; this section is not permission to disregard those protections.

12. Errors, inaccuracies, and omissions

We may correct errors in descriptions, pricing, promotions, availability, shipping information, or other content. If an error affects an accepted order, we will contact you and resolve it according to applicable law, including any right to cancel and receive a refund. We will not impose an undisclosed additional charge after purchase without your agreement.

13. Prohibited uses

Use the Services lawfully. You must not engage in fraud, impersonation, unlawful harassment, infringement, spam, unauthorized collection of personal information, distribution of malware, interference with the Services, or circumvention of security and access controls. Do not exploit protected content or systems through unauthorized scraping or automated access. Automated or agent-based access must comply with section 14 and any applicable access restrictions. We may suspend access for a breach, subject to applicable law and without removing rights attached to existing purchases.

14. Agents

This section applies when software or a service takes autonomous or semi-autonomous action on a person's behalf to access or interact with the Services. Such an agent may access the Services only while identifying itself, complying with our access requirements, and respecting any request to stop. We may use technical measures to limit agent access.

Agents must identify themselves in HTTP or HTTPS requests using an Agent/[agent name] user-agent identifier; must not conceal their automated identity, impersonate human interactions, or bypass CAPTCHAs or other access controls; must answer truthfully when asked whether an interaction is automated; and must respect measures that block, limit, or control access. This section does not authorize access otherwise prohibited by law or our applicable controls.

15. Termination

We may suspend or terminate access for breach of these Terms or other legitimate reasons, subject to applicable law. Amounts lawfully due remain payable. Termination does not eliminate our responsibilities for accepted orders or your non-waivable consumer rights. Provisions that by their nature should continue, including intellectual property, privacy, and lawful liability and dispute provisions, survive termination.

16. Disclaimer of warranties

To the extent permitted by law, informational content and optional online features are provided as is and as available, without a guarantee of uninterrupted or error-free operation. We do not exclude any express product promise we make, our Refund Policy commitments, or mandatory warranties and consumer guarantees concerning product quality, description, fitness, safety, durability, or delivery. Where the law does not allow an exclusion, that exclusion does not apply.

17. Limitation of liability

To the extent permitted by law, we and our relevant service providers are not responsible for indirect or consequential losses arising from misuse of the Services or events for which we are not legally responsible. No provision excludes liability for fraud, for death or personal injury where exclusion is unlawful, for required refunds or consumer remedies, or for any other liability that cannot lawfully be excluded or limited. Any limitation applies only to the extent valid under the law applicable to your purchase.

18. Indemnification

To the extent permitted by law, you agree to indemnify us and the relevant service providers for third-party claims and reasonable associated costs caused by your unlawful conduct, infringement of another party's rights, or material breach of these Terms. This does not require you to indemnify a party for that party's own unlawful conduct or override consumer protections. We will notify you of a relevant claim, allow reasonable cooperation in its defense, and will not agree to a settlement imposing non-monetary obligations on you without your consent.

19. Severability

If a provision is held invalid or unenforceable, it applies only to the extent lawfully enforceable or is severed as necessary. The remaining provisions continue to apply to the extent permitted by law.

20. Waiver and entire agreement

A failure to enforce a provision is not a waiver of the right to enforce it later. These Terms, the policies incorporated here, and the specific terms disclosed for an accepted purchase form the applicable agreement, subject to mandatory law. They do not remove representations, protections, or rights that the law requires us to honor.

21. Assignment

You may not transfer contractual rights or obligations without our consent where consent is lawfully required. We may transfer the operation of the Services and associated agreements as permitted by law, without reducing your statutory rights, and will provide notice where required.

22. Governing law and disputes

The law applicable to the transaction governs these Terms. Mandatory consumer protections and any right to bring a claim before a court or authority available under the law of your residence are not displaced by these Terms. Contact us first with a concern so we can try to resolve it; doing so is not a condition that prevents you from exercising a statutory right.

23. Headings

Headings are for convenience and do not change the meaning of the Terms.

24. Changes to these Terms

We may update these Terms for future use and purchases. The date above identifies the current version. We will provide notice of material changes where required by law. Updates do not retrospectively remove rights or agreed terms for an earlier order.
